Terms & Conditions
These Terms and Conditions govern your use of Watching Lanka and any booking made through https://watchinglanka.com. By using the website or completing a booking, you agree to these terms.
1. About Us
- Watching Lanka is operated by Travel AI (PVT) Ltd, Sri Lanka.
- We provide an online platform to discover, request, reserve and pay for travel activities, tours, transport and related services.
- Some services are operated by independent local suppliers. The relevant listing and booking confirmation will identify the service details and inclusions.
2. Eligibility and Account Use
- You must provide accurate and complete information when using the website or making a booking.
- A booking must be made by a person legally able to enter into a contract. A parent or legal guardian must make or approve bookings for minors.
- You are responsible for protecting your login, OTP and booking information from unauthorized use.
3. Acceptable Website Use
- You may use the website only for lawful personal or authorized business purposes.
- You must not misuse the website, attempt unauthorized access, interfere with its operation, copy protected content, submit false bookings or use automated tools without permission.
4. Listings and Availability
- We aim to keep descriptions, images, schedules, prices and availability accurate, but information may be supplied by third-party operators and may change.
- Images may be illustrative. Exact vehicles, guides, routes, equipment or activity conditions may vary where reasonably necessary.
- A displayed activity is not guaranteed to be available until the booking is confirmed.
5. Bookings, Prices and Payments
- The total price, currency, taxes, service charges, inclusions and exclusions will be shown before payment or confirmation.
- A booking becomes confirmed only when the required payment or payment authorization is completed and a confirmation is issued.
- For Reserve Now and Pay Later bookings, the payment deadline and confirmation status shown in the booking details apply.
- Payments may be processed by third-party payment providers. We generally do not store complete payment-card details.
- You are responsible for bank charges, exchange-rate differences or other charges imposed by your payment provider.
Stripe Payment Services
- Our online payments may be processed by Stripe, an independent third-party payment service provider.
- When making a payment through Stripe, you must provide accurate and valid payment information.
- A payment may be declined, delayed or require additional verification because of security checks, authentication requirements or fraud-prevention measures applied by Stripe, your bank or your card issuer.
- Bank fees, foreign transaction charges and currency exchange-rate differences are outside the control of Travel AI (PVT) Ltd.
- By completing a payment through Stripe, you also agree to the applicable terms and privacy practices of Stripe.
6. Supplier and Activity Rules
- You must follow the safety, age, health, identification, timing, meeting-point, equipment and conduct requirements shown in the listing or communicated by the operator.
- The operator may refuse participation where a requirement is not met or where participation may create a safety risk.
- Unless the listing says otherwise, entrance tickets, permits, meals, transport, equipment and other optional costs are not included.
7. Changes and Cancellations
- Each booking is subject to the cancellation and amendment rules shown on the activity page and during checkout.
- Requests to change a date, time, participant count, pickup point or other booking detail are subject to availability and possible price differences.
- If we or the operator must make a material change, we will try to offer a suitable alternative, reschedule or refund according to the applicable booking terms.
- Weather, sea conditions, road closures, government restrictions, safety concerns or other events outside reasonable control may require changes or cancellation.
8. Reviews and User Content
- Any review, image or other content you submit must be truthful, lawful and respectful.
- You grant us permission to display, format and use submitted content for operating and promoting the service, while you retain ownership of your original content.
- We may remove content that is misleading, unlawful, abusive, infringing or unrelated.
9. Intellectual Property
- The Watching Lanka name, website design, software, text, graphics and other original materials are owned by or licensed to Travel AI (PVT) Ltd.
- No content may be copied, republished, sold or commercially reused without written permission, except where allowed by law.
10. Responsibility and Liability
- We will provide our platform and services with reasonable care.
- Independent operators remain responsible for delivering the activities they operate.
- To the extent permitted by law, we are not responsible for indirect losses, personal items, missed connections or losses caused by incorrect information provided by the customer.
- Nothing in these terms limits rights or liability that cannot legally be limited or excluded.
11. Suspension and Termination
- We may restrict or suspend access, cancel fraudulent bookings or refuse service where there is suspected fraud, abuse, non-payment, unlawful conduct or a serious breach of these terms.
12. Governing Law and Disputes
- These terms are governed by the laws of Sri Lanka, subject to any mandatory consumer rights that apply in the customer's country.
- Please contact our support team first so we can try to resolve any complaint fairly.
- If a dispute cannot be resolved, it may be referred to the competent courts or authorities as permitted by applicable law.
13. Updates and Contact
- We may update these terms when our services, business processes or legal requirements change. The latest version will be published on the website with its effective date.
